The new child support statute changes how the court deals with second families. Under the old law, a parent could only reduce his/her net income for purposes of calculating child support by payments of child support to another family if ordered by the court. Parents were forced to pay guideline support for a child/children from a previous marriage as if they were the only child/children that the parent was supporting. even if the parent was supporting many children from a current marriage. The new law allows a parent to deduct the lesser of the actual costs for supporting his/her children with another person or 75% of the applicable guideline support for the other children even if there is no order of support or the child/children are from your current marriage. The change in the law may significantly lower the amount of child support previously ordered by the court.
Be aware that the new law provides that child care and medical expenses be pro-rated by the net income of the parties.
